This website is operated by Factbinger (“Factbinger,” “we,” “us,” “our”). We provide a free service that helps homeowners and authorized occupants request and compare window-related estimates and offers from independent third-party contractors and companies (“Service Providers”).
No contractor relationship: Factbinger is not a Service Provider, does not perform window work, and does not guarantee pricing, availability, financing, rebates, timelines, or outcomes.
You must be at least 18 years old and located in the United States to use this site. By submitting information, you represent that you are the homeowner or have authorization from the homeowner/authorized occupant to request window services for the property.
We collect the information you submit and transmit it to one or more Service Providers so they can contact you with estimates, offers, or service options. Service Providers are solely responsible for their communications, quotes, work quality, licensing, insurance, compliance, warranties, and any agreements you enter into with them.
Factbinger is not responsible for Service Provider acts or omissions, and Factbinger does not supervise, direct, or control Service Providers’ work or communications.

You agree to provide accurate, current, and complete information. If you submit false, incomplete, or misleading information, results may be inaccurate and Service Providers may be unable to contact you.
You authorize Factbinger to share your submitted information with Service Providers for the purpose of providing estimates, offers, and related communications.
Express written consent: By submitting your information and/or checking any consent box on this site, you provide your express written consent for Factbinger and Service Providers (and their agents, vendors, and marketing partners acting on their behalf) to contact you at the phone number and email address you provide regarding your request.
Contact methods may include telephone calls, SMS/text messages, and email, including by automated technology (such as autodialers) and/or prerecorded/artificial voice, where permitted by law. You understand that you may receive communications from multiple Service Providers.

Cross-border processing: Factbinger is based in Germany and may process data in Germany and other locations. Your information will be shared with U.S.-based Service Providers and vendors. Please read carefully. This section affects your rights, including your right to file a lawsuit in court and to have a jury trial.
Informal resolution first: Before starting arbitration or a court proceeding, you agree to contact us with a written description of the dispute and your preferred resolution by emailing contact@factbinger.com. The parties will attempt to resolve the dispute informally for at least 30 days.
Binding arbitration: If a dispute is not resolved informally, you and Factbinger agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the site will be resolved by binding arbitration on an individual basis, except as set out below. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (or other applicable AAA rules).
Arbitration location / remote: Arbitration may be conducted by videoconference, telephone, written submissions, or in the U.S. county of your residence, depending on what the arbitrator determines is appropriate under the rules and the circumstances.
Exceptions: Either party may bring an individual claim in small claims court if it qualifies, or seek injunctive or equitable relief for alleged unlawful use of intellectual property or security-related issues.
Class action waiver: You and Factbinger agree that disputes will be resolved only on an individual basis. You waive any right to bring or participate in a class action, class arbitration, collective action, private attorney general action, or representative proceeding.
Severability of class waiver: If a court or arbitrator determines that the class action waiver is unenforceable for a particular claim, then that claim (and only that claim) will be severed and may proceed in court, while the remaining claims will be arbitrated.
Opt-out of arbitration: You may opt out of arbitration by sending an email to contact@factbinger.com within 30 days of first accepting these Terms, stating your name, the URL of this site, and that you wish to opt out of arbitration. If you opt out, disputes will be handled as described in the Governing Law / Venue section below.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles, and subject to the Federal Arbitration Act (“FAA”) for arbitration provisions.
If arbitration does not apply to a claim, or if a claim proceeds in court consistent with Section 16, you and Factbinger agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware, unless prohibited by mandatory consumer protection laws.
